Welcome to TrustSetu. These Terms of Service ("Terms") govern your access to and use of TrustSetu's website, platform, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account or using TrustSetu, you confirm that:

• You are at least 18 years old
• You are authorized to represent the organization you register
• All information you provide is accurate and complete
• You will comply with all applicable laws and regulations
• You accept and agree to be bound by these Terms

2. Account Registration and Security

2.1 Account Creation

To use TrustSetu, you must create an account by providing accurate and complete information about your organization. You agree to:

• Provide truthful information about your organization
• Maintain the accuracy of your account information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access

2.2 Account Responsibility

You are responsible for all activities that occur under your account. TrustSetu is not liable for any loss or damage arising from your failure to maintain account security.

3. Service Description and Availability

3.1 Services Provided

TrustSetu provides a cloud-based management platform for Trusts, NGOs, and Sanghs, including:

• Donation receipt management and PDF generation
• Member and family member database management
• Complete accounting system (income, expense, bank, cash book)
• Financial reporting and analytics
• Donor PAN card management with encryption
• Data export capabilities

3.2 Service Modifications

We reserve the right to:

• Modify or discontinue any feature or service with notice
• Update, enhance, or change the platform functionality
• Perform scheduled maintenance (with advance notice)
• Make emergency changes to ensure security and stability

4. Subscription Plans and Payments

4.1 Free Trial

New users receive a 30-day free trial period with full access to all features. No credit card is required for the trial period. At the end of the trial, you can continue with a free plan (with limitations) or subscribe to a paid plan for full access to all features.

4.2 Subscription Fees and Payment Processing

Subscription fees are charged according to the plan you select. All payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway. By subscribing, you agree to:

• Pay all fees associated with your chosen plan
• Authorize automatic recurring payments for annual subscriptions
• Accept that fees are non-refundable except as required by law
• Accept our Terms and Conditions before subscribing to any paid plan

Payment Processing: We use Razorpay to process all subscription payments. Your payment information is handled securely by Razorpay in accordance with their security standards and privacy policy. We do not store your complete credit card or bank account details.

4.3 Terms Acceptance for Paid Plans

Before subscribing to any paid plan, you must read and accept our Subscription Terms and Conditions. This acceptance is mandatory and recorded for legal compliance. The terms include important information about:

• Software provided "as is" without warranties
• Limitation of liability for software bugs or errors
• No obligation to provide updates or maintenance
• Access revocation policies

4.4 Price Changes

We may change subscription prices with 30 days' notice. Continued use of the Services after price changes constitutes acceptance of the new prices.

5. User Responsibilities and Prohibited Activities

5.1 Acceptable Use

You agree to use TrustSetu only for lawful purposes. You will NOT:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Services
• Use the platform for fraudulent activities
• Share your account credentials with unauthorized persons
• Reverse engineer or copy our software

5.2 Data Accuracy

You are responsible for the accuracy of all data you enter into the platform, including donor information, financial records, and member details. TrustSetu is not liable for errors in your data.

6. Intellectual Property Rights

6.1 Ownership

TrustSetu and its licensors own all rights, title, and interest in the Services, including:

• Software, code, and technology
• Trademarks, logos, and branding
• Documentation and content
• Design and user interface

6.2 Your Data

You retain all rights to the data you input into TrustSetu. We claim no ownership over your organization's data, member information, or donation records. You can export your data at any time.

7. Data Privacy and Security

Your use of TrustSetu is also governed by our Privacy Policy. We implement industry-standard security measures including:

• Bank-grade encryption for sensitive data
• Secure cloud storage with regular backups
• Role-based access control
• SSL/TLS encryption for data transmission
• Regular security audits

8. Termination

8.1 Termination by You

You may terminate your account at any time by:

• Canceling your subscription through your account settings
• Contacting our support team

Upon termination, you will have 30 days to export your data before it is permanently deleted.

8.2 Termination by TrustSetu

We may suspend or terminate your account if:

• You violate these Terms
• Payment for your subscription fails
• We suspect fraudulent or illegal activity
• Your account poses a security risk

9. Disclaimers and Limitations of Liability

9.1 Service Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTSETU SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Errors or inaccuracies in your data
• Service interruptions or delays
• Third-party actions or content

Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TrustSetu, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your data or content

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with Indian arbitration laws. The arbitration shall be conducted in English in Rajkot, Gujarat, India.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the platform. Your continued use of the Services after such notification constitutes acceptance of the modified Terms.

13. Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force
• Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision
• Assignment: You may not assign these Terms without our written consent. We may assign these Terms without restriction
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrustSetu
